SMS Messaging Terms & Compliance (A2P/CTIA/TCPA)
This section applies if you opt in to receive SMS/text messages from SMG Solutions LLC. These provisions are intended to satisfy A2P/TCPA/CTIA program disclosure expectations (identity, opt-out/help, frequency, rates, carriers, and privacy policy reference).
1) Program Description
This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with SMG Solutions LLC through our website or scheduling forms and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages may include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
2) Cancellation Instructions (STOP)
You can cancel the SMS service at any time. Simply text “STOP” to the phone number +1 925-393-0183 . Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
3) Support Information (HELP)

4) Carrier Liability
Carriers are not liable for delayed or undelivered messages.
5) Message Frequency; Message & Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
6) Supported Carriers
Our SMS program works with all major U.S. wireless carriers and most regional carriers.
7) Age Restriction
You must be 18 years or older to participate in our SMS program.

9) No Sale/Sharing of SMS Consent for Third-Party Marketing

General Terms
1) Acceptance of Terms

3) Services; General Information vs. Client Engagements
SMG Solutions LLC provides professional consulting and implementation services, which may include Salesforce advisory and delivery, automation and systems integration, AI enablement, marketing/CRM workflow optimization, and related business and technology services (“Consulting Services”).
Any information provided on the Site (including articles, templates, examples, guides, videos, checklists, and other content) is provided for general informational purposes and may not reflect your specific situation. It is not intended to be, and should not be relied upon as, individualized professional advice.
When SMG Solutions provides Consulting Services to a client, those services are provided pursuant to a separate written agreement (such as a Master Services Agreement, Statement of Work, or similar contract) that governs scope, deliverables, fees, responsibilities, and applicable terms.
4) Eligibility
You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Site or Services on behalf of an entity, you represent you have authority to bind that entity.
Intellectual Property Rights
1) Our Limited License to You
This Site and all materials available on the Site are the property of SMG Solutions LLC and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal non-commercial use. To the maximum extent permitted by law, SMG Solutions LLC’s total liability for any claim arising out of or related to the Site or Services will not exceed the amount you paid to SMG Solutions LLC for the services giving rise to the claim in the three (3) months before the event first occurred, or $100, whichever is greater.
(Some jurisdictions do not allow certain limitations; in such cases, liability will be limited to the fullest extent permitted by law.)
Indemnification
You agree at all times to indemnify and hold harmless SMG Solutions LLC, its affiliates, and their respective officers, directors, agents, and employees from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms of Service.
Online Commerce
Certain sections of the Site may allow you to purchase products and services from third-party vendors. We are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of these products and services. Dispute Resolution; Arbitration; Class Action Waiver

1) Informal Resolution First
Before filing a claim, you agree to contact us at support@SMGSolutionsLLC.com with a brief written description of the dispute and your contact information. We will attempt to resolve the dispute informally.
2) Binding Arbitration
If we cannot resolve the dispute within thirty (30) days, you and SMG Solutions LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or Services will be resolved by binding arbitration administered by a recognized arbitration provider, conducted in Contra Costa County, California (or by video/telephone if appropriate), under the provider’s rules.
3) Class Action Waiver
You and SMG Solutions LLC agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
4) Exceptions
Either party may seek injunctive relief in court for misuse of intellectual property or unauthorized access/security issues, and claims eligible for small claims court may be brought there.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the state in which SMG Solutions LLC operates. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in that jurisdiction (subject to the Dispute Resolution section above).
Changes to Terms of Service
We may update these Terms of Service from time to time. The latest version will always be available on our website with the effective date.
